Terms and conditions of sale on the Maroc Horizon d'Aventures Travel & Tourism website

These are all the measures and terms and conditions of sale and transactions that may be concluded on the website aventuremaroc.com of the travel and tourism agency Maroc Horizons d'Aventures, whose headquarters are located at 76, Av Al Khawarizmi, Cité Al Massira, 80050 Agadir - Morocco. Any order placed on this website implies the customer's unconditional and irrevocable acceptance of these terms and conditions.

It is assumed that any order placed by a customer and fulfilled in part or in full is done so with the customer's full consent, without reservation or refusal.


Purpose

The order can only be fulfilled after it has been validated by payment via the Interbank Electronic Banking System (SMI, formerly Maroc Télécommerce) platform or another physical or remote means of payment with justification.

Maroc Horizon d'Aventures offers its customers the possibility of paying for their orders by all possible means, in particular via the Internet on the aventeuremaroc.com website, which is a service and a registered trademark of Maroc Horizons d'Aventures S.A.R.L, or by bank transfer to our bank account or in cash to one of our agents in the cities where we are present.


Definit​ions

A “Distance Contract” is deemed to be concluded between a “consumer, customer, or tourist” and Maroc Horizon d'Aventures s.a.r.l. for the purchase of a service or goods that are the subject of a reservation, via the Internet, concluded and executed via the same network. 

“The Consumer”: any natural or legal person who uses the services of Maroc Horizon d'Aventures s.a.r.l. to purchase and consume a product or service offered for sale on our website or customized through an exchange of emails between us.

“Order Form”: a tool for requesting a product or service by a “Consumer” from Maroc Horizon d'Aventures s.a.r.l., which must be validated by the consumer and commit Maroc Horizon d'Aventure to the commercial transaction and commencement of the sale, which can only take place after proof of payment has been provided.

“Order”: the product or service sold or performed by Maroc Horizons d'Aventures.


Article 1. IDENTITY OF THE SERVICE PROVIDER:

The website aventuremaroc.com is owned by the agency Maroc Horizons d'Aventures, located at No. 76, Av. Al Khawarizmi, Cité Al Massira, Agadir, Morocco. Holder of travel agent license No. 06D/04, RC 13385, ICE: 001555167000045, Capital 500,000.00 Dhs

By using the aventuremaroc.com website, the “Consumer” acknowledges having read and accepted the terms and conditions of use. The “Consumer” or customer also undertakes to provide accurate information.


Article 2. METHODS OF PAYMENT FOR SERVICES OR PAYMENT METHODS:

2.1 Payment method:

- To pay for your order, you choose the payment method from those offered by aventuremaroc.com on the payment page.

- In the case of online payment, the transaction will be debited from your account on the day following the date of confirmation of the “order.”

- Your multi-channel payments are secured by the Centre Monétique Interbancaire (CMI), which offers a fully secure payment service in Morocco.

- In the case of payment by credit card, any fraudulent use of the payment method provided for in the agreements between the Consumer and the card issuer and between Maroc Horizons d'Aventures and its banking institution shall apply.

- In the case of cash payment, an invoice is delivered to the “consumer” by the agent who collects the payment.

2.2 Proof of payment by credit card:

- The data recorded by the CMI Interbank Electronic Banking Center on the multi-channel payment platform on behalf of Maroc Horizons d'Aventures constitutes proof of all commercial transactions between the “Consumer” and Maroc Horizons d'Aventures.  

2.3 Other payment methods:

For all bookings on the aventuremaroc.com website, only the following means of payment are accepted:

1- Credit cards.

2- Payment by money order, PayPal, Western Union, etc.

3- Payment in agency (in cash or certified check deposit).


Article 3. RESERVATION AND CONFIRMATION:

3.1. Reservation:

The “Consumer” must identify themselves on their own account by creating a login and password.

They can then make their reservation by choosing a service or product in their shopping cart.

The basket reservation is finalized when they proceed to payment and confirm the reservation.

3.2. Confirmation:


The final confirmation of the “Consumer's” basket can only be made after receipt of full payment for their order and final confirmation by Maroc Horizon d'Aventures of the availability of the reserved product.


Article 4. PRICES OF SERVICES

-Each service has a price as long as it is available. The service and its composition are clearly detailed, specifying what is included and what is not.

Packages may be offered with hotel names for reference purposes only, followed by the words “or similar.” Maroc Horizon d'Aventures confirms the names of the hotels before proceeding to the payment stage by the “Consumer.” In the event that our room allocation is not available in hotel “x,” another hotel ‘y’ of a similar category is systematically offered to the “Consumer.”


Article 5. MODIFICATION, CANCELLATION, AND REFUND

5.1. Modification and cancellation by the customer:

All reservations are considered firm and cannot be canceled except under certain conditions. If cancellation or modification of the reservation is possible, it may incur a fee.

5.2 Modification and cancellation by Maroc Horizons d'Aventures:

In the event of a forced cancellation of the trip by the agency Maroc Horizons d'Aventures, the latter shall offer the “Consumer” a full refund of the costs incurred for reservations made for hotels, excursions, visits, or similar trips.

5.3 Refund

No refund requests will be accepted in the event of changes made to the package (airline tickets, hotels, itineraries, excursions, etc.) by its suppliers beyond the control of Maroc Horizons d'Aventures.

5.4 Disputes and complaints

Maroc Horizons d'Aventures acts as an intermediary between customers and various service providers and can therefore only accept complaints that fall under its direct responsibility and not that of its partners. It may act as a party concerned with the “Consumer” to defend the latter's interests and help them obtain compensation and interest.


Article 6. ADMINISTRATIVE FORMALITIES

The traveler is required to check:

- The validity of their passport, generally no less than 3 to 6 months before the date of return from the trip, depending on their nationality. This is their direct responsibility.

- Entry formalities for Morocco, including health and other restrictions.

- Other documents necessary for their trip: (visa, authorization to leave the country, parental authorization, etc.). 

The agency is not responsible in the event of refusal of boarding or disembarkation by the Moroccan authorities.


Article 7. JURISDICTION

Any dispute shall be settled amicably. In the event of a dispute, only the court of the city of Agadir shall have jurisdiction.
